:ביטול עסקה
ביטול עסקה שבוצעה בתחנת שירות/מכירה באפשרות לקוח פרטי שהינו “צרכן” כהגדרתו בחוק הגנת הצרכן, תשמ”א 1981- לבטל/לסיים את העסקה, כמפורט להלן: תוך 14 יום ממעמד הקניה בתנאי שבמוצר אותו רכש לא התבצע שימוש והוא מוחזר באריזתו המוקרית
הגבלת אחריות
VIPCOM, עובדיה, וכל הבאים מטעמה לא יישאו באחריות נזיקין או חוזית לכל נזק אלא לנזק ישיר שנגרם עקב הגבלת השירותים, התלייתם, ניתוקם, או הפסקתם, לרבות עקב טעות במתן השירותים, טעות במסר בזק או השמטה ממנו, אי מסירת מסר בזק או איחור במסירתו, מסירת מסר בזק למען בלתי נכון או רישום מוטעה במדריך מנויים או בפרסום אחר של VIPCOM, ולכל נזק הנובע מפעולה מכוונת או מרשלנות חמורה שלנו, עובדיה או הבאים מטעמה
VIPCOM, עובדיה, וכל הבאים מטעמה לא יישאו באחריות לפי ההסכם במקום שחל פטור לגבי אחריות מכוח סעיף 41 לחוק התקשורת (בזק ושידורים), התשמ"ב – 1982 , או במקום שבו נגרם הנזק עקב הפעלת אמצעים למניעת הונאה, במידה הדרושה לצורך איתור ההונאה והפסקתה
כמו-כן VIPCOM, עובדיה וכל הבאים מטעמה לא יישאו בכל אחריות לכל נזק שייגרם על-ידי נסיבות מעבר לשליטתה, ובכל זאת כח עליון, אש, מלחמה, פעולות חבלה, הפרעות קשות בסדר הציבורי, מחסור במקורות סבירים לאספקה של ציוד חיוני למערכת, מעשה או מחדל של ספק תקשורת אחר או מגבלות שהוטלו על-ידו, חוקים, תקנות או צווים ממשלתיים, מגבלות הרשת שאין בהן כדי חריגה מתנאי הרישיון, מגבלות צבאיות או ביטחוניות, אמצעים למניעת הונאה, או עילות אחרות שאינן בשליטתנו, הכל בכפוף לכך שהמקרים האמורים אינם בשליטתנו ושעל אף מאמצים סבירים אין באפשרותה לעמוד בהתחייבויותיה. הוראות אלו חלות על כל מי שמשתמש במכשירך, ובאחריותך ליידע אותו על כך
